Standards of Protection: In Search of the ‘Average Consumer’ of EU Law in the Proposal for a Consumer Rights Directive

Abstract

Abstract: The notion of the ‘average consumer’ is a vital concept in EU consumer law. It functions as an anchor point for the standards of protection that can be justified under the free movements regulation, and also sets the standard for the level of protection pursued by harmonising legislation. It is surprising, therefore, that little attention is paid to this concept in the creation of new EU consumer legislation. This paper considers whether the review of the consumer acquis, in particular the proposal for a Consumer Rights Directive, should open the way for aligning the ‘average consumer’ notion from the Directives with the benchmark set in EU law in order to ensure greater legal certainty. To that end, it first seeks to identify the position of the standards set by the existing four Directives and the text of the proposal in relation to the ‘reasonably circumspect’ consumer of EU law. Secondly, in order to align the different notions of the ‘average consumer’ in EU law and in the Directives, the article argues that lessons can be learnt from the example set by the Unfair Commercial Practices Directive. It proposes a new legislative technique – dubbed ‘targeted differentiation’ – through which greater alignment between free movements regulation and EU consumer legislation can be achieved. Résumé: La notion de « consommateur moyen » est un concept essentiel en droit européen de la consommation. Cette notion est non seulement un point de référence pour les modèles de protection qui peuvent se justifier dans la réglementation sur la liberté de circulation mais elle fournit également un modèle de degré de protection recherché dans la législation d’harmonisation. C’est pourquoi il est étonnant que peu d’attention ait été consacrée à ce concept lors de l’élaboration de la nouvelle législation européenne sur les droits du consommateur. Le présent article étudie la question de savoir si l’examen de l’acquis concernant le consommateur, en particulier la proposition d’une Directive sur les droits du consommateur, devrait ouvrir la voie à un alignement de la notion du « consommateur moyen » provenant des Directives sur le critère établi en droit de l’UE, ceci en vue d’assurer une plus grande sûreté juridique. A cette fin, l’article tente tout d’abord de déterminer la position des modèles de protection utilisés dans les quatre Directives existantes et le texte de la proposition en relation avec le consommateur « raisonnablement prudent » du droit de l’UE. Deuxiémement, afin d’aligner les différentes notions du « consommateur moyen » en droit de l’UE et dans les Directives, l’article démontre que des enseignements peuvent être tirés de l’exemple donné par la Directive sur les pratiques commerciales déloyales. Il propose une nouvelle technique législative – qualifiée « différentiation ciblée » – grâce à laquelle on peut arriver à un plus grand ajustement entre la réglementation sur la liberté de circulation et la législation sur le consommateur européen.
