Abstract: The Criminal Justice Act 1991 threatens to create a climate and a set of procedures which will result in an increased rate of breach in probation orders. The author considers the justajkations for such a new approach and concludes that they are likely to result in counterproductive practice which has little to offer the courts, the service or its clients. He concludes by offering some practical suggestionr through which the dangers of the new breach‐enthusiasm might be avoided and a more productive minimalist approach in this area reafirmed.
