S.99 of the EPA requires employers who propose to make redundant an employee of a kind in respect of which an independent union is recognised, to consult representatives of that union. A ‘representative’ is defined by s.99(2) as ‘an official or other person authorised to carry on collective bargaining with the employer by that union’. Thus a shop steward is normally such a representative ( General & Municipal Workers’ Union v. Wailes Dove Bitumastic Ltd ). These keywords were added by machine and not by the authors.
