This chapter is concerned with the quandary of situations in which human rights instruments can ironically function in ways that end up obstructing the making of humanity. It suggests that such situations bring out the fundamentally aporetic character of any concrete institutionalized project of making humanity. The discussion focuses on second-generation human rights—economic, social, and cultural rights—in order to bring out the structurally problematic character of sovereign humanity because this is the type of human rights where the axiom of the human being as a valuable resource or useful capacity is the most apparent.
