This chapter examines the relation between possession and use in the concept of property. It begins with some general remarks about the formal nature of possessory rights in property. It then argues for the priority of possession over use both directly, by showing how the concept of a property right is necessarily formal, and indirectly, by showing that attempts to generate a formal right as an overinclusive version of an interest in use must fail.
