Abstract This chapter explores the human right to subsistence. It argues that while subsistence exchange contracts significantly differ from standard coercion, the choice of accepting them is just as non-voluntary as in the most extreme cases of standard coercion. In both cases, the right-holder’s choice is driven by the fact that every other option is unsustainable. The interest in subsistence is so urgent that, first, inadequate subsistence is unsustainable, and, second, it is liable to outweigh the interest in the object of any other right. Subsistence exchange contracts therefore constitute a potential threat to the enjoyment of every other human right.
