Any analysis of the role of the law in industrial relations which exclusively, or even mainly, concentrated upon the operations of the Conservative Government’s trade union legislation would be, at best, very limited. There has been a clear increase in the juridification of industrial relations which can be traced back at least two decades; that is to well before the election of Mrs Thatcher (Clark, 1985). This process has found an expression in the passage of the new legislation but cannot be reduced to it.
