It is over 20 years since the publication of the Alain Supiot’s much acclaimed work Critique du droit du travail.1 In this time, Western societies have witnessed a profound transformation in the nature of work; technology and the organisation of production; and, according to the author’s latest work, the very nature of law. The legal analysis that makes up La Gouvernance par les nombres is firmly situated within this context, a rapidly evolving world of globalised capitalism. This book goes beyond the boundaries of labour law, the primary focus of Critique, in order to provide an insightful analysis of the Western legal structure in its full complexity. Its purpose is to provide readers with a much needed legal analysis of what the author refers to as ‘neoliberal’ law, or ‘governance by numbers’ and to shed light on the impact it is having upon Western society. In this book, the author offers a profound and analytically rigorous piece of socio-legal analysis that, by reason of the social ontological method employed, must be seen as more than a mere ideological critique of neoliberalism. He places his analysis of ‘neoliberal law’ firmly in its socio-historical context in order to provide what is a detailed juridical analysis of its form and function in globalised capitalist society. The book should be seen as an important resource for labour lawyers and legal theorists alike. It offers a new way of thinking about law and its relationship with society, and forces us to think creatively about how to address the challenges facing us today (p 21).
