La nueva Ley 9/2017 incorpora al ordenamiento espanol varias disposiciones de gran importancia en el ambito laboral al abordar al subcontratacion de obras y servicios. Entre ellas destacan el refuerzo de la necesidad de respetar el convenio colectivo sectorial, la inclusion de clausulas sociales en los pliegos de licitacion y la influencia de la normativa laboral en la fase de ejecucion. No obstante, muchas de estas previsiones son oscuras y sera necesaria una considerable accion de los Tribunales para determinar su alcance verdadero. The new Act 9/2017 incorporates into the Spanish legal system several provisions of great importance in the labour field when dealing with subcontracting of works and services. These include strengthening the need to respect the branch collective agreement, the inclusion of social clauses in the bidding documents and the influence of labour regulations in the execution phase. However, many of these articles are obscure and considerable action by the Courts will be necessary to determine their true scope.
