Many historians and lawyers have stressed the systematic disregard for the protection of the historic heritage in the Spanish legislation of the 18th and 19th centuries. The 1978 Constitution was radically transformed Spanish legislation. Without this framework it would have been impossible to enact the 1985 Historical Heritage law. The new Law has an all-embracing definition of the historical heritage: any buildings, and fixed or movable objects of artistic, historic, palaeontological, archaeological, ethnographic, scientific, or technical interest. The Law of the Spanish Historical Heritage has created the legal concept of archaeological heritage. Administrative authorization operates through a licensing system that is superior to that laid down in the 1911 Law and 1912 Regulations. The new legislation on property rights has solved the old problem of private initiatives, and at the same time strengthened public ownership of archaeological material.
