O trabalho analisara o percurso tracado pelo sindicalismo, desde a formacao autonoma do Direito do Trabalho (Estado Liberal) ate a consolidacao do ramo (Estado Social). The work intends, as initial objective, to demonstrate the paths taken by unions, from the autonomous formation of Labor Law (Liberal State) to its consolidation (Welfare State). In a sequel, it will investigate the consecration of freedom of association as a human right and its relation to the democratic and pluralist parameters of the Democratic State of Law. This correlation would allow, by inserting the workers into the centers of power, not only to implement the principle, but also to rethink the role of the unions, now that they are grounded to the State's paradigms. From this, a new way is proposed to face the crisis of identity and organization that affects Brazilian trade union movement, allowing his internal and external reconfiguration so that it can reassume its historical role as an actor of the construction, development and affirmation of Labor Law.
