The present contribution analyses the key role of international jurisprudence and quasijurisprudence in the development of indigenous peoples’ rights relating to the environment, focusing on its extensive and creative approach, in particular with regard to the interpretation of treaty provisions, the development of collective rights, the connection between environmental issues and human rights, human rights’ justiciability, and the flexible use of legal sources and other jurisprudence, arguing that the latter may facilitate the circulation of legal solutions in this field and that this jurisprudential elaboration may also have an impact outside of the human rights sphere.
