The National Labor Relations Board (NLRB) is an independent agency of the federal government established in 1935 to administer and enforce the National Labor Relations Act (NLRA or Wagner Act). The NLRB has exclusive jurisdiction over nearly all cases arising under the NLRA, although its decisions can be appealed to the U.S. Circuit Court of Appeals. The NLRB’s authority in most cases is delegated to thirty-three regional directors throughout the United States, whose decisions are subject to review by the NLRB. The NLRB’s primary function is to administer and decide two types of cases: representation cases and unfair labor practice cases. Both types are initiated by filing papers with the local regional director’s or resident office. An order for enforcement of an NLRB decision may be obtained in the U.S. Circuit Court having territorial jurisdiction over the employer.
