The adoption of the European Works Council Directive on 22 September 1994 marked the creation of the first institution of collective employment law at European level. Since 15 December 1997, following extension to the United Kingdom, the Directive now applies in every Member State of the European Union. In addition, it also embraces Iceland, Norway and Liechtenstein as Member States of the European Economic Area. The European Works Council Directive is rooted in an approach based on the principle of negotiation. Rather than specifying a large number of substantive requirements it creates scope for negotiation - albeit accompanied by a set of backup provisions should negotiations fail. Empirical study of actual developments, for which European Works Councils offer an exemplary object of study, may help to provide some initial answers and assessments.
