Abstract This introductory chapter maps the main arguments and methodology of the work. The introduction begins by highlighting the variety of instances in which the human rights of workers and employees have been infringed upon by their employer. The central question that runs throughout the chapters is whether those rights are effectively and appropriately protected by the labour laws of England and Wales. An overview of the chapters will be given, as well as an explanation of the methodology underpinning the analysis offered, noting a focus upon the qualified rights of the European Convention on Human Rights and how they are protected against the employer’s managerial authority. The horizontal effect of human rights in disputes between private parties is the foundation of the evaluation of national labour law offered in the book. A brief account of this feature concludes the chapter.
