Abstract Three forms of functional participation have been analysed until now, namely, the EESC, tripartite advisory committees, and information agencies; the first two having mainly a role in regulatory policy-making, the latter in persuasive policy-making. The fourth form of functional participation under research is the European social dialogue. It can be part of the normal regulatory intervention but can equally be a regulatory alternative to such legislative action. Moreover, ‘social dialogue ‘ is strongly encouraged by the European social dimension of the 1990s preferring ‘new modes of governance ‘ to the ‘old regulatory Community method ‘.
