The article explores the theoretical and regulatory foundations of the use of outsourcing in modern social and labor relations. The scientific approaches of domestic and foreign authors to the definition of the concept of "outsourcing" have been systematized, its main substantive features have been identified and the author's definition of this category has been proposed. Outsourcing is considered as a form of organization of individual functions and business processes with the involvement of an external specialized contractor. We analyzed the provisions of the civil and labor legislation of the Russian Federation governing relations arising from the use of outsourcing technologies. Particular attention is paid to the distinction between outsourcing and the provision of labor for employees (personnel). Benefits and potential risks of outsourcing for organizations and employees are identified. It was concluded that the legal regulation of outsourcing is fragmented and that further improvement of the conceptual framework and labor legislation of the Russian Federation is necessary.
