Sweden has a unique system for the referral of employment rights disputes to judicial adjudication, both individual and collective, under which cases cannot be brought to the Labour Court by a worker, although he/she can go to the District Court. Only trade unions, the Discrimination Ombudsman, an employers’ association, or an employer who has entered into a collective agreement can lodge claims. The Labour Court itself has a mixed composition of legally qualified presiding members, expert members drawn from government departments or public agencies and nominees of the main labour market actors.
